Summary
In land consolidation procedures under the Land Consolidation Act of the Federal Republic of Germany (FlurbG) it often happens that land owners or their whereabouts are unknown. In such cases, section 119 FlurbG provides for the ex officio appointment of a representative, but the judicial officers have different requirements for the investigative measures to be carried out by the land consolidation authority. The article discusses the requirements resulting from the general principle of official mediation, evaluates the relevant case law on section 119 FlurbG and compares it with the ex officio appointment of representatives in other jurisdictions. This results in the legally necessary requirements for the investigative measures of the land consolidation authority in connection with section 119 FlurbG.
