Zusammenfassung
Summary
In Germany, common forest management by forest cooperatives exists since medieval times. However, the establishment of new cooperatives is only possible in North Rhine-Westphalia and Thuringia due to missing legal regulations in all other federal states. This contribution presents an alternative based on federal law using the example of the land consolidation procedure Kell am See, administrative district »Landkreis Trier-Saarburg«. The basis is section 40 (2) Land Consolidation Act (Federal Republic of Germany): »If it serves the purpose of land consolidation and if the owners agree, land owned in common may also be split up in other cases or be reorganized into joint ownership.«
