Zusammenfassung
Der Artikel befasst sich mit Rechtsgrundlagen des vereinfachten Flurbereinigungsverfahrens zur Landentwicklung nach § 86 FlurbG. In Heft 4/2004 dieser Zeitschrift hat der Autor allgemein die Anordnungsvoraussetzungen und Sondervorschriften dargestellt (Thiemann 2004). Hieran knüpft der folgende Beitrag an und erörtert, inwieweit es sinnvoll ist, gemäß der Sondervorschrift in § 86 Abs. 2 Nr. 5 FlurbG auf den Wege- und Gewässerplan mit landschaftspflegerischem Begleitplan zu verzichten.
Summary
This contribution deals with the legal basis of the simplified land consolidation procedure for land development after Section 86 Land Consolidation Act in the Federal Republic of Germany. In number 4/2004 of this journal, the author had generally presented the conditions of the order and special regulations. This paper picks up the thread and discusses, in how far it makes sense, according to the special regulation in Section 86 (2) Paragraph 5 to waive the road and water resources plan with accompanying landscape conservation plan.
