Zusammenfassung
Die Agri-Photovoltaik verbindet die agrarische Nutzung (Ackerbau, Dauergrünland, Gemüse-, Obst- und Weinanbau) mit der Solarstromerzeugung auf einer Fläche, der sogenannten Projektfläche. Je Agrarbetrieb ist in räumlich-funktionalem Zusammenhang eine entsprechende Anlage in der freien Landschaft mit einer Modulfläche von bis zu 25.000 m² als begünstigtes Vorhaben generell zulässig. Möglich ist auch, dass vor allem größere Anlagen auf der Grundlage eines Bebauungsplanes errichtet und betrieben werden. Aufbauend auf den Überlegungen im Beitrag »Grundsätzliche Aspekte zur Bewertung und Zuteilung von Solarenergieflächen in Flurbereinigungsverfahren und offene Fragen« (Thiemann und Hendricks 2025) zeigt der Artikel auf, wie die Bewertung und Zuteilung von Agri-Photovoltaik-Flächen in Flurbereinigungsverfahren konkret vorzunehmen sind. Dabei werden sowohl von Agrarbetrieben eigengenutzte Anlagen als auch von Dritten betriebene Agri-Photovoltaik-Anlagen (Agri-PVA) näher betrachtet. Um alle möglichen Fälle zu behandeln, ist eine äußerst differenzierte Behandlung der verschiedenen Konstellationen notwendig.

Agri-photovoltaics combines agricultural use (arable farming, permanent grassland, vegetable, fruit, and wine growing) with solar power generation in a single area, known as the project area. For each agricultural business, a corresponding installation in the open countryside with a module area of up to 25,000 m² is generally permissible as a beneficiary project in a spatially functional context. It is also possible that larger facilities in particular will be constructed and operated on the basis of a development plan. Building on the considerations in the article “Fundamental Aspects of the Evaluation and Allocation of Solar Energy Areas in Land Consolidation Procedures and Open Questions” (Thiemann and Hendricks 2025), the article shows how the evaluation and allocation of agri-photovoltaic areas in land consolidation procedures should be carried out in concrete terms. Both systems used by agricultural businesses themselves and agri-photovoltaic systems operated by third parties are examined in more detail. In order to cover all possible cases it is necessary to take a highly differentiated view of the various constellations.
