Berücksichtigung der ökologischen Landwirtschaft in der Flurbereinigung

Zusammenfassung

Die Anzahl der Landwirte, die nach ökologischen Kriterien wirtschaften, wächst in Deutschland beständig. Die EU-Vorgaben sowie die Regelungen der Erzeugerorganisationen geben Restriktionen bei der Bewirtschaftung der Flächen vor. Sofern in Flurbereinigungsverfahren anerkannte ökologisch wirtschaftende Betriebe beteiligt sind, sind Besonderheiten bei der Wertermittlung, der Erstellung des Planes nach § 41 FlurbG und des Flurbereinigungsplanes zu berücksichtigen. Insbesondere muss der Besitzübergang langfristig geplant und gegebenenfalls zeitlich gestaffelt werden.

Summary

In Germany, the number of farmers who manage their business pursuant to ecological criteria is growing permanently. Requirements of the European Union and regulations of producer organizations give restrictions for the cultivation. If ecologically managing agricultural hol-dings are participating in a land consolidation procedure, certain specifics exist that have to be taken into account in valuation and realization of the plan pursuant to Section 41 Land Consolidation Act (Federal Republic of Germany) (road and water resources plan with accompanying landscape conservation plan) and the land consolidation plan. Especially the transfer of possession has to be planned in the long term and has to be staggered temporally, if necessary.
