Summary
So far, land consolidation in cases of permissible compulsory acquisition procedures has been applied predominantly for the realization of infrastructural measures with the aid of land consolidation procedures. Besides the allocation of areas for these infrastructural measures, the compensation measures caused by these procedures were also provided. This paper will seek to show land consolidation in cases of permissible compulsory acquisition procedures exclusively where they concern the realization of measures for species conservation. The trigger for these measures for species conservation is the enlargement of a brown coal digging area in the »Rheinisches Braunkohlerevier«. Additionally, details of the planning law for the extraction of brown coal will be presented, as well as information about the basic conditions under which the land consolidation in cases of permissible compulsory acquisition procedures for the realization of measures for species conservation were started and applied in that context.
