Zusammenfassung
Der I. Zivilsenat des Bundesgerichtshofs hat in seinem Urteil vom 20.07.2006 für Recht erkannt, dass die Beklagte das Recht der Klägerin als Datenbankherstellerin gemäß § 87b Abs. 1 UrhG verletze, indem sie die von der Klägerin herausgegebenen Bodenrichtwerte einschließlich der wertbestimmenden Parameter und Grundstücksmarktberichte übernimmt und ihrem Kundenkreis im Internet zum Abruf anbietet. Die Klägerin kann als Herstellerin der Datenbank die Rechte aus §§ 97, 87a ff. UrhG geltend machen. Die herausgegebene Sammlung genießt als Datenbank Suigeneris-Schutz nach § 87b Abs. 1 UrhG und ist nicht als amtliches Werk gemäß § 5 UrhG gemeinfrei. Hersteller einer Datenbank ist nach § 87a Abs. 2 UrhG, wer die Investitionen nach § 87a Abs. 1 UrhG vorgenommen hat.

Summary
The I. Civil Panel of the Federal Court of Justice has adjudged in its conviction of 20.07.2006, that the defendant injures the copyright of the complainant as database producer according to § 87b Abs. 1 UrhG, by copying the derived standard land values including the defined value parameters and property market reports of the complainant and offering the data to her clients in the Internet. The complainant as database producer can assert the copyrights according to §§ 97, 87a et seqq. UrhG. The edited data enjoys as database the Suigeneris-Protection according to § 87b Abs. 1 UrhG and is not common property as an official work according to § 5 UrhG. According to § 87a Abs. 2 UrhG, database producer is who has undertaken the investment according to § 87a Abs. 1 UrhG.
