Zusammenfassung
In Heft 4/2004 dieser Zeitschrift hat der Autor allgemein die Anordnungsvoraussetzungen und Sondervorschriften des vereinfachten Flurbereinigungsverfahrens zur Landentwicklung dargestellt (Thiemann 2004). Hieran knüpft der folgende Beitrag an und erörtert, inwieweit das Verfahren nach § 86 FlurbG zur Ermöglichung von Landentwicklungsmaßnahmen und Auflösung von Landnutzungskonflikten einsetzbar ist. Im Ergebnis zeigt sich, dass die Flurbereinigung im Rahmen des Anspruchs aller Teilnehmer auf wertgleiche Landabfindung zur bodenordnerischen Konfliktbewältigung und gleichzeitigen Unterstützung von Maßnahmen der Landentwicklung eingesetzt werden kann. Denn der Schutz des Grundeigentums vor Flächenansprüchen, die sich aus öffentlichen Vorhaben ergeben, liegt im ureigensten Interesse der Grundstückseigentümer, auch wenn die intendierte Konfliktauflösung verfahrensimmanent mit einer Landbereitstellung für eben diese Vorhaben verbunden ist.

Summary
In number 4/2004 of this journal, the author had generally presented the conditions of the order and special regulations of a simplified land consolidation procedure of land development. This paper picks up the thread and discusses, in how far the procedure after § 86 FlurbG is applicable to enable measures of land development and disintegration of conflicts of land use. The result shows that the land consolidation can be applied in the frame of the claim of all participants on compensation in land of equal value to solve land regulating conflicts and, at the same time, to support measures of land consolidation. This is because the protection of the property against claims of land that arise from public projects is in the land owners’ best interest, even though the intended disintegration of conflicts inherent in the procedure is involved with a provision of land for exactly this project.
